The U.S. Supreme Court today issued a 5-4 decision blocking DHS's efforts to end the DACA (Deferred Action for Childhood Arrivals) program, finding that the decision to rescind DACA was arbitrary and capricious under the Administrative Procedures Act (APA). Justice Roberts wrote the majority opinion. The court addressed only whether the agency complied with the procedural requirement that it provide a reasoned explanation for ending the DACA program, leaving DHS to formulate a new argument. However, the Court's judgment means that, for now, DACA recipients continue to be temporarily protection from deportation.
